There is hereby established a board to be known as the Protection

PART V PAYMENT FROM THE FUND

Payment
Subject to subsections (1B) and (2) where it appears

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an
ication referred to it under this section or may for those
purposes
ire the Commissioner to make further inquiries relating
to the

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

the employer employs less than 20 employees;
sufficient evidence exists to support the presentation of a

if the employer is a company, that he is unable to pay his debts;

Where the Commissioner exercises his discretion under
subsection (1)

in his

Nothing in subsection (2) shall require the Commissioner to give

For the purpose of verifying any application under section 15,
or if
equired by the Board under section 17 (3), the Commissioner may

《铁岭市农作物种子生产经营管理办法》业经2006年1月5日铁岭市第五届人民政府第25次常务会议通过,现予公布,自2006年4月1日起施行。

铁岭市农作物种子生产经营管理办法
第一章 总则
第一条 为了保护和合理利用农作物种质资源,规范农作物品种选育和种子生产、经营、使用、管理行为,维护品种选育者和种子生产者、经营者、使用者的合法权益,提高种子质量水平,保持和发展我市种子生产优势,推动种子产业化进程,促进种植业发展,根据《中华人民共和国种子法》(以下简称《种子法》)和《辽宁省农作物种子管理条例》及有关法律、法规、规章的规定,结合我市实际,制定本办法。
第二条 在我市行政区域内从事农作物品种选育、引进、推广和种子生产、经营、使用、管理以及检验的单位和个人,应当遵守本办法。
本办法所称种子,是指用于农作物生产的籽粒、果实和、根、茎、苗、芽、叶等种植材料或者繁殖材料。
第三条 市、县(市)区人民政府农业行政主管部门主管本行政区域内的农作物种子工作,其所属的种子管理机构受其委托具体负责种子管理工作。
公安、工商、交通、质监等相关部门应当支持、配合农业行政主管部门做好种子管理工作。
第四条 市、县(市)区人民政府将种子管理工作经费列入本级财政预算。
第五条 市、县(市)区人民政府应当根据科教兴农方针和种植业发展的需要制定种子发展规划,并按照国家有关规定在财政、信贷、税收等方面采取措施保证规划的实施。
扶持种质资源保护工作和选育、生产、更新、推广使用良种,鼓励品种选育和种子生产、经营相结合,奖励在种质资源保护工作和良种选育、推广、管理等工作中成绩显著的单位和个人。
第六条 依法保护种质资源,任何单位和个人不得侵占和破坏。
禁止采集或者采伐国家和省重点保护涉及农作物的天然种质资源。因科研等特殊情况需要采集或者采伐的,应当经国务院或者省人民政府农业行政主管部门批准。
第七条 鼓励外省、市单位和个人来我市依法生产、经营种子,市、县(市)区人民政府农业行政主管部门及相关部门应当给予支持,为种子生产、经营者提供相关服务。
第八条 种子使用者有权按照自己的意愿购买种子,任何单位和个人不得非法干预。
第九条 各级农业行政主管部门应当建立举报制度,接受投诉和举报,对举报有功者予以奖励,并为举报人保密。
第二章 生产管理
第十条 主要农作物的商品种子生产实行许可制度。
主要农作物杂交种子及其亲本种子、常规种原种种子的生产许可证由生产所在地县(市)、区人民政府农业行政主管部门审核,经市人民政府农业行政主管部门同意,报省农业行政主管部门核发。主要农作物常规种子的大田用种生产许可证,在县(市)、区辖区内生产的,由生产所在地县(市)、区人民政府农业行政主管部门核发;跨县(市)、区生产的,由市人民政府农业行政主管部门核发。
第十一条 申请种子生产许可证的,由直接组织种子生产的单位或个人提出申请。
委托农民或乡村集体经济组织生产的,由委托方提出申请;委托其他经济组织生产的,由委托方或者受托方提出申请。
第十二条 申请领取种子生产许可证应当具备下列条件:
(一)具有繁殖种子的隔离和培育条件;
(二)具有无检疫性病虫害的种子生产地点;
(三)生产常规种子(含原种)和杂交亲本种子的,注册资本100万元以上;生产杂交种子的,注册资本500万元以上;
(四)有500平方米以上的种子晒场或者种子烘干设备;
(五)有600平方米以上的仓储设施;
(六)有能够满足检验需要的检验室;
(七)有经省级以上农业行政主管部门考核合格的种子检验人员2名以上,专业种子生产技术人员3名以上;
(八)法律、法规规定的其他条件。
申请领取具有植物新品种权的种子生产许可证的,应当征得品种权人的书面同意。
第十三条 鼓励单位和个人建立稳定的种子生产基地,实现种子产业化、专业化、标准化生产。
种子生产基地,是指接受委托承担种子生产的乡村或者区域(含隔离区)。种子生产基地应当具备下列条件:
(一)具有适宜种子生产的自然条件;
(二)隔离区外边线至整个生产区域中的所有土地承包者自愿或者村民大会(代表大会)通过决议同意承担种子生产,并制订相关的村规民约;
(三)上一生产季无违反种子生产技术操作规程和拒售、外流不良记录。
第十四条 申请领取种子生产许可证应当向审核机关提交以下材料:
(一)主要农作物种子生产许可证申请表,需要保密的由申请者注明;
(二)种子质量检验人员和种子生产技术人员资格证明;
(三)注册资本证明材料;
(四)检验设施和仪器设备清单、照片及产权证明;
(五)种子晒场情况介绍或种子烘干设备照片及产权证明;
(六)种子仓储设施照片及产权证明;
(七)种子生产地点的检疫证明和种子生产具体村、屯及地块名称、隔离区设置方案、前茬作物等情况介绍;
(八)种子生产基地所有土地承包者自愿承担种子生产的证明或村民会议决议文件及相关的村规民约;
(九)生产品种介绍,品种为授权品种的,应当提供品种权人书面同意证明或品种转让合同;生产种子是转基因品种的,应当提供农业转移基因生物安全证书;
(十)种子生产质量保证制度。
第十五条 申请种子生产许可证按以下程序办理:
(一)申请者按本办法第十一条的规定向审核机关提出申请。
(二)审核机关应当在收到申请材料之日起20日内完成审核工作。审核时对生产地点、土地承包者、晾晒烘干设施、仓储设施、检验设施和仪器进行实地考察,并制作现场勘验记录。对具备本办法规定条件的,签署审核意见,按本办法第十条规定报请审批;审核不予通过的,书面通知申请人并说明原因。
(三)审批机关应当在收到审核意见之日起20日内完成审批工作。对符合条件的,发给生产许可证;不符合条件的,退回审核机关并说明原因。审核机关应当将不予批准的原因书面通知申请人。审批机关认为有必要的,可进行实地审查。
第十六条 种子生产许可证应当注明许可证编号、生产者名称、生产者住所、法定代表人、发证机关、发证时间、生产种子的作物种类、品种、地点、有效期限等项目。
种子生产许可证有效期限为3年。在种子生产许可证有效期内,许可证注明项目变更的,应当根据本办法第十五条规定的程序,于实施种子生产之日起60日前申请办理变更手续,并提供相应证明材料。
种子生产许可证期满后需申请新证的,应当在期满前3个月持原证重新申请。重新申请的程序和原申请程序相同。
申请者3年内未依法履行种子生产合同,有下列行为之一未纠正的,其项目变更、换发新证申请,审核机关不予受理:
(一)拒收、限收种子生产基地合格种子的;
(二)不按合同兑现种子收购价款的;
(三)其他损害种子生产基地合法权益的行为。
禁止伪造、变造、买卖、租借种子生产许可证;禁止任何单位和个人无证或者未按照许可证的规定生产种子。
第十七条 取得种子生产许可证的单位和个人,可以委托乡村集体经济组织、其他经济组织或者农民生产种子,生产种子前,双方应当签订书面合同。合同约定生产的种子应当符合国家种用质量标准;国家没有规定种用质量标准的,合同当事人应当约定质量标准。
签订种子生产合同应当使用省农业行政主管部门和省工商行政管理机关联合制订的合同文本,并报生产地种子管理机构备案。
禁止无种子生产许可证的单位和个人以代繁、代管等名义与种子生产基地签订主要农作物种子生产合同。
第十八条 种子生产者应当严格按照种子生产技术规程和种子检验、检疫规程组织和管理种子生产。
种子生产者应当向种子生产基地提供合格的亲本种子和包括播种、去杂、去雄、降水等种子生产全过程的详细生产技术操作规程。种子生产基地应严格按照种子生产技术操作规程进行生产和管理,保证种子质量,不得使用非合同供种方提供的亲本种子。
第十九条 同一隔离区内只允许一个种子生产者委托生产种子。
任何单位和个人不得在种子生产基地内种植影响种子生产的农作物,不得进行病虫害接种试验及从事其他危害种子生产的活动。
第二十条 对符合国家种用质量标准或者合同约定种用质量标准的种子,种子生产者应当按合同收购,不得拒收或限量收购。
对达不到国家种用质量标准或者合同约定种用质量标准的种子,种子生产者应当报告种子生产所在地的种子管理机构,并在其监督下报废、收购、转商,不得冒充种子销售。因报废、转商所造成的损失,由责任方承担。种子生产基地交售种子时,不得掺杂使假。
除签订种子生产合同的种子生产者外,其他任何单位和个人不得收购种子生产基地的种子。种子生产基地不得向非合同收购方出售种子。
第二十一条 商品种子生产应当建立种子生产档案,载明生产地点、生产地块环境、前茬作物、亲本种子来源和质量、技术负责人、田间检验、记录、产地气象记录、种子流向等内容。
第三章 经营管理
第二十二条 种子经营实行许可制度。种子经营者必须先取得种子经营许可证后,方可凭种子经营许可证向工商行政管理机关申请办理或者变更营业执照。
种子经营许可证实行分级审批发放制度。主要农作物杂交种子及其亲本种子、常规种原种种子经营许可证,由种子经营者所在地县(市)、区人民政府农业行政主管部门审核,经市人民政府农业行政主管部门报省人民政府农业行政主管部门核发。其他种子经营许可证,在县(市)、区辖区内经营的,由经营所在地县(市)、区人民政府农业行政主管部门核发;跨县(市)、区经营的,由市人民政府农业行政主管部门核发。
第二十三条 申请主要农作物杂交种子经营许可证的单位和个人,应当具备如下条件:
(一)申请注册资本500万以上,资产负债率70%以下,并具有独立承担民事责任的能力;
(二)有能够满足检验需要的检验室,仪器达到一般种子质量检测机构的标准,有2名以上经省级以上农业行政主管部门考核合格的种子检验人员;
(三)有成套的种子加工、包装设备和1名以上经省级以上农业行政主管部门考核合格的种子加工技术人员;
(四)种子贮藏库房应当在600平方米以上;种子晒场应当在500平方米以上;有1名以上经省级以上农业行政主管部门考核合格的种子贮藏、保管技术人员;
(五)具有稳定的营业场所,并应形成相对稳定的销售网络;
(六)法律、法规规定的其他条件。
第二十四条 申请主要农作物杂交种子以外的其他种子经营许可证的单位和个人,应当具备如下条件:
(一)申请注册资本:100万元以上,资产负债率在75%以下,具有独立承担民事责任的能力;
(二)具有能够满足检验工作需要的检验室及相应的检验仪器设备,有1名以上经省级农业行政主管部门考核合格的种子检验人员;
(三)具有与经营种子的种类、数量相适应的固定营业场所及加工、包装、贮藏、保管设施和掌握种子贮藏、加工、保管技术的人员;
(四)法律、法规规定的其他条件。
第二十五条 申请种子经营许可证应向审核机关提交以下材料:
(一)农作物种子经营许可证申请表;
(二)种子检验人员、贮藏保管人员、加工技术人员资格证明;
(三)种子检验仪器、加工设备、仓储设施清单、照片及产权证明;
(四)种子经营场所照片;
(五)注册资本证明材料。
第二十六条 申请种子经营许可证按以下程序办理:
(一)申请者按本办法第二十二条规定向审核机关提出申请;
(二)审核机关应在收到申请材料之日起20日内完成审核工作。审核时应当对经营场所、加工仓储设施、检验设施和仪器进行实地考察。对具备本办法规定条件的,签署审核意见,按本办法第二十二条规定报请审批;审核不予通过的,书面通知申请人并说明原因;
(三)审批机关应在收到审核意见之日起20日内完成审批工作。对符合条件的,发给种子经营许可证;不符合条件的,退回审核机关并说明原因。审核机关应将不予批准的原因书面通知申请人。审批机关认为有必要的,可进行实地审查。
第二十七条 种子经营许可证应当注明种子经营范围、经营方式及有效期限、有效区域等项目。
种子经营许可证有效期为5年,在种子经营许可证有效期限内,许可证注明项目变更的,应当根据本办法第二十六条规定的程序,办理变更手续,并提供相应证明材料。
种子经营许可证期满后申领新证的,种子经营者应在期满前3个月,持原证重新申请。重新申请的程序和原申请的程序相同。
禁止伪造、变造、买卖、租借种子经营许可证;禁止任何单位和个人无证或者未按照许可证的规定经营种子。
第二十八条 下列3种情况可以不办理种子经营许可证,但种子经营者应当在办理或者变更营业执照后15日内,向当地种子管理机构备案:
(一)专门经营不再分装的包装种子的;
(二)受具有种子经营许可证的种子经营者在其经营许可证规定的有效区域内书面委托代销其种子的;
(三)种子经营者在其经营许可证规定的有效区域内设立分支机构的。
第二十九条 种子经营者必须在种子经营许可证的有效区域内销售或者委托代销种子,委托代销种子应当与代销方签订代销协议。代销方应当在代销协议范围内从事代销活动,并不得再次委托代销种子。
代销方不得接受无种子经营许可证的单位或者个人的委托销售种子。
第三十条 种子经营者应当遵守有关法律、法规的规定,向种子使用者提供种子的简要性状、主要栽培措施、使用条件的说明与有关咨询服务,并对种子质量负责。
任何单位和个人不得非法干预种子经营者的自主经营权。
第三十一条 销售的种子应当加工、分级、包装(不能加工、包装的除外)。
下列农作物种子应当加工、包装后销售:
(一)有性繁殖作物的籽粒、果实、包括颖果、荚果、蒴果、核果等;
(二)马铃薯微型脱毒种薯。
下列农作物种子可以不经加工、包装进行销售:
(一)无性繁殖的器官和组织,包括根(块根)、茎(块茎、鳞茎、球茎、根茎)、枝、叶、芽、细胞等;
(二)苗和苗木,包括蔬菜苗、水稻苗、果树苗木、茶树苗木、花卉苗木等;
(三)其他不宜包装的种子。
大包装或者进口种子可以分装;实行分装的,应当注明分装单位,并对种子质量负责。
第三十二条 销售的种子应当附有标签,其标注的内容应当与销售的种手相符。本办法所称的标签是指固定在种子包装物表面及内外的特定图案及文字说明。对于可以不经加工包装进行销售的种子,标签是指种子经营者在销售种子时向种子使用者提供的特定图案及文字说明。
农作物种子标签应当标注作物种类、种子类别、品种名称、产地、种子经营许可证编号、质量指标、检疫证明编号、净含量、生产年月、生产商名称、生产商地址及联系方式。
属于下列情况之一的,应当分别加注:
(一)主要农作物种子应当加注种子生产许可证编号和品种审定编号;
(二)两种以上混合种子应当标注“混合种子”字样,标明各类种子的名称及比率;
(三)药剂处理的种子应当标明药剂名称、有效成分及含量、注意事项;并根据药剂毒性附骷髅或十字骨的警示标志,标注红色“有毒”字样;
(四)转基因种子应当标注“转基因”字样、农业转移基因生物安全证书编号和安全控制措施;
(五)进口种子的标签应当加注进口商名称、种子进出口贸易许可证编号和进口种子审批文号;
(六)分装种子应注明分装单位和分装日期;
(七)种子中含有杂草种子的,应加注有害杂草的种类和比率。
禁止盗用、伪造种子标签进行种子经营活动。
为防范和打击盗用、伪造种子包装和种子标签等违法行为,种子经营者可以根据需要,向经营所在地种子管理机构提供种子包装和标签样本。
第三十三条 标签标注内容应当使用规范的中文,印刷清晰,字体高度不得小于1.8毫米,警示标志应当醒目,可以同时使用汉语拼音和其他文字,字体应小于相应的中文。
标签标注内容可直接印制在包装物表面,也可制成印刷品固定在包装物外或放在包装物内。作物种类、品种名称、生产商、质量指标、净含量、生产年月、警示标志和“转基因”标注内容必须直接印制在包装物外。
可以不经加工包装进行销售的种子,标签应当制成印刷品在销售种子时提供给种子使用者。印刷品的制作材料应当有足够的强度,长和宽不应小于12厘米×8厘米。可根据种子类别使用不同的颜色,育种家种子使用白色并有紫色单对角条纹,原种使用蓝色,亲本种子使用红色,大田用种使用白色或者蓝红以外的单一颜色。
第三十四条 种子经营者应当建立种子经营档案,载明种子来源、加工、贮藏、运输和质量检测各环节的简要说明及责任人、销售去向等内容。
一年生农作物种子的经营档案应当保存至种子销售后2年;多年生农作物种子的经营档案保存期限按国家农业行政主管部门规定执行。
第三十五条 种子广告的内容应当符合《种子法》和有关广告法律、法规的规定,主要性状描述应与审定公告一致。
应当审定的农作物品种未经审定通过的,不得发布广告。
第三十六条 种子生产基地调出种子时,种子生产者应当出具由责任人签发的调运证明,载明调运品种名称、数量、生产地点、调往地点、调往单位、调运时间和承运车辆牌号等内容。
调运或者邮寄出县的种子应当附有检疫证书。
第三十七条 主要农作物品种在引进、推广应用前,应当通过国家级或者省级审定。未经审定的主要农作物品种不得经营、推广。
申请引进国家审定但适种区域不包括我省或外省审定的主要农作物品种的,须经我市种子管理机构组织种植试验,适应种植的报省人民政府农业行政主管部门同意后,方可引种。
其他农作物品种的选育和引进,经生产或经营地县、市两级农业行政主管部门向省农业行政主管部门备案。
第三十八条 为境外制种进口种子的,应当具有对外制种合同,进口的种子只能用于制种,其产品不得在国内销售。从境外引进农作物试验用种,应当隔离栽培,收获物也不得作为商品种子销售。
第四章 质量管理
第三十九条 市、县(市)区种子管理机构具体负责种子质量的监督。
种子管理机构可以组织专家实施田间现场鉴定及委托种子质量检验机构对种子质量进行检验。
进出口种子严格按照国家相关法律、法规、规章规定管理。
第四十条 经省有关主管部门考核合格的种子质量检验机构,承担种子质量检验工作。
种子质量检验机构应当配备种子检验员。种子检验员应当具备以下条件:
(一)具有相关专业中等专业技术学校毕业以上文化水平;
(二)从事种子检验技术工作3年以上;
(三)经省级以上人民政府农业行政主管部门考核合格。
因种子质量发生纠纷的,当事人可以向所在地种子质量检验机构提出检验申请。当事人对检验结果有异议的,可以在收到检验结果之日起15日内向上级种子质量检验机构提出复检。
第四十一条 种子管理、检验机构和相关部门在检查种子质量抽取(扦取)样品时,应当由种子检验员(扦样员)按国家标准执行。种子检验员(扦样员)执行任务时应当出示种子检验员证。
拒绝接受依法监督抽查的,给予警告,责令改正;拒不改正的,被监督抽查的种子按不合格种子处理,由下达监督抽查任务的农业行政主管部门予以通报。
第四十二条 种子在大田种植后,因种子质量或者栽培、气候等原因,导致田间出苗、植株生长、作物产量、产品品质等受到影响,双方当事人对造成事故的原因或者损失程度存在分歧,为确定事故原因或(和)损失程度可以向田间现场所在地的县(市)、区或市种子管理机构申请田间现场技术鉴定。
种子质量纠纷处理机构根据申请,可以进行现场鉴定;种子质量纠纷当事人可以共同申请现场鉴定,也可以单独申请现场鉴定。
鉴定申请一般以书面形式提出,说明鉴定的内容和理由,并提供相关材料。口头提出鉴定申请的,种子管理机构应当制作笔录,并请申请人签字确认。申请人应当按有关规定和实际支出缴纳鉴定费和聘请专家费用。
种子管理机构对申请人的申请进行审查,符合条件的,应当及时予以鉴定;不予受理的,书面通知申请人并说明原因,返还缴纳的费用。
现场鉴定由种子管理机构组织专家鉴定组进行,具体鉴定办法按照农业部《农作物种子质量纠纷田间现场鉴定办法》执行。
第四十三条 禁止生产、经营假、劣种子。
下列种子为假种子:
(一)以非种子冒充种子或者以此种品种种子冒充他种品种种子的;
(二)种子种类、品种、产地与标签标注的内容不符的。
下列种子为劣种子:
(一)质量低于国家规定的种用标准的;
(二)质量低于标签标注指标的;
(三)因变质不能作种子使用的;
(四)杂草种子的比率超过规定的;
(五)带有国家规定检疫对象的有害生物的。
第四十四条 由于不可抗力原因,为生产需要必须使用低于国家或者地方规定的种用标准的农作物种子的,应当经用种地市或县(市)、区人民政府批准。
第四十五条 种子使用者因种子质量问题遭受损失的,出售种子的经营者应该予以赔偿;经营者赔偿后,属于种子生产者或者其他经营者责任的,经营者有权向生产者或者其他经营者追偿。赔偿额包括购种价款、有关费用和可得利益损失。
前款所称可得利益损失,是指因种子造成的该作物实际产量与所在县(市)、区当年统计平均产量的减产部分,按当年当地同类作物市场平均价格确定。
第四十六条 因使用种子发生民事纠纷的,当事人可以通过协商或者调解解决。当事人不愿通过协商、调解解决或者协商、调解解决不成的,可以根据当事人之间的协议向仲裁机构申请仲裁。当事人也可以直接向人民法院起诉。
第五章 监督管理
第四十七条 农业行政主管部门是种子行政执法机关,可以依法进行现场检查。种子执法人员依法执行公务时应当统一标志并出示行政执法证件。任何单位和个人不得拒绝、阻碍种子执法人员依法执行公务。
第四十八条 种子执法人员查处种子生产、经营违法行为时,可以查阅、复制、摘录有关合同、发票、帐簿、检验结果、标签等相关资料,现场检查种子生产、经营、贮藏场所;可以查封涉嫌违法种子,并在7日内作出处理决定。
第四十九条 农业行政主管部门在依照本办法实施有关证照的核发工作中,除收取所发证照的工本费外,不得收取其他费用。
第五十条 农业行政主管部门、种子管理机构及其工作人员不得参与和从事种子生产、经营活动。
第六章 法律责任
第五十一条 生产、经营假、劣种子的,按《种子法》第五十九条规定,由县级以上人民政府农业行政主管部门或者工商行政管理机关责令停止生产、经营,没收种子和违法所得,吊销种子生产许可证、种子经营许可证或者营业执照,并处以罚款;有违法所得的,处以违法所得5倍以上10倍以下罚款;没有违法所得的,处以2000元以上5万元以下罚款;构成犯罪的,依法追究刑事责任。
第五十二条 有下列行为之一的,按《种子法》第六十条规定,由县级以上人民政府农业行政主管部门责令改正,没收种子和违法所得,并处以违法所得1倍以上3倍以下罚款;可以吊销违法行为人的种子生产许可证或者种子经营许可证;构成犯罪的,依法追究刑事责任:
(一)未取得种子生产许可证或者伪造、变造、买卖、租借种子生产许可证,或者未按照种子生产许可证的规定生产种子的;
(二)未取得种子经营许可证或者伪造、变造、买卖、租借种子经营许可证,或者未按照种子经营许可证的规定经营种子的。
第五十三条 有下列行为之一的,按《种子法》第六十一条规定,由县级以上人民政府农业行政主管部门责令改正,没收种子和违法所得,并处以违法所得1倍以上3倍以下罚款;没有违法所得的,处以1000元以上2万元以下罚款;构成犯罪的,依法追究刑事责任:
(一)为境外制种的种子在国内销售的;
(二)从境外引进农作物种子进行引种试验的收获物在国内作商品种子销售的;
(三)未经批准私自采集或者采伐国家重点保护的天然种质资源的。
第五十四条 有下列行为之一的,按《种子法》第六十二条规定,由县级以上人民政府农业行政主管部门或者工商行政管理机关责令改正,处以1000元以上1万元以下罚款:
(一)经营的种子应当包装而没有包装的;
(二)经营的种子没有标签或者标签内容不符合法律规定的;
(三)伪造、涂改标签或者试验、检验数据的;
(四)未按规定制作、保存种子生产、经营档案的;
(五)种子经营者在异地设立分支机构未按规定备案的;
(六)销售授权品种或审定通过的品种,未使用批准名称的;
(七)主要农作物种子标签未加注种子生产许可证编号和品种审定编号的。
第五十五条 违反本办法规定,经营、推广应当审定而未经审定通过的种子,以及未经同意或者试验,擅自引种、推广主要农作物品种的,按《种子法》第六十四条规定,由县级以上人民政府农业行政主管部门责令停止种子的引种、经营、推广,没收种子和违法所得,并处以1万元以上5万元以下罚款。
第五十六条 在种子生产基地进行病虫害接种试验的,按《种子法》第六十七条规定,由县级以上人民政府农业行政主管部门责令停止试验,处以5万元以下罚款。
第五十七条 在种子生产基地种植影响种子生产的农作物等从事危害种子生产活动的,由县级以上人民政府农业行政主管部门责令停止侵害;给使用者、生产者造成经济损失的,应当依法承担赔偿责任。
第五十八条 销售授权品种未使用其注册登记的名称的,按《中华人民共和国植物新品种保护条例》第四十二条规定,由县级以上人民政府农业行政主管部门责令限期改正,可以处1000元以下的罚款。
第五十九条 假冒授权品种的,按《中华人民共和国植物新品种保护条例》第四十条规定,由县级以上人民政府农业行政主管部门责令停止假冒行为,没收违法所得和植物品种繁殖材料,并处违法所得1倍以上5倍以下的罚款;情节严重,构成犯罪的,依法追究刑事责任。
第六十条 农业行政主管部门依法吊销违法行为人的种子经营许可证后,应当通知工商行政管理机关依法注销或者变更违法行为人的营业执照。
第六十一条 农业行政主管部门、种子管理机构及其工作人员有下列行为之一的,由所在单位或者上级行政主管部门给予行政处分;构成犯罪的依法追究刑事责任:
(一)参与和从事种子生产、经营活动;
(二)违反规定条件发放或者拒绝发放种子生产、经营许可证;
(三)核发许可证滥收费;
(四)侵犯农民生产经营自主权及其他合法权益的。
第六十二条 违反本办法规定,强迫种子使用者违背自己的意愿购买、使用种子给使用者造成损失的,应当承担赔偿责任。
第六十三条 当事人认为有关行政机关的具体行政行为侵犯其合法权益的,可以依法申请行政复议,也可以依法直接向人民法院提起诉讼。
第七章 附则
第六十四条 以“示范用种”、“试验用种”名义销售种子的,属经营、推广行为。
第六十五条 主要农作物是指稻、小麦、玉米、棉花、大豆、油菜、马铃薯、高梁。
种子生产者是指取得种子生产许可证的单位和个人。
种子经营者是指取得种子经营许可证的单位和个人或者依法取得种子其他经营资格的单位和个人。
第六十六条 本办法由铁岭市农村经济委员会负责解释。
第六十七条 本办法自2006年4月1日起施行。1999年铁岭市人民政府颁布的《铁岭市农作物种子管理暂行办法》(铁政发(1999]5号)同时废止。
